General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions apply to all orders placed through our online shop. Any conflicting terms and conditions of the customer shall not apply unless we expressly agree to them in writing.

2. Contracting Party

3. Offers and Formation of the Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding product overview.

The contract is concluded once we confirm the customer’s order by email.

4. Product Characteristics

Our musical instruments are predominantly made from natural materials such as wood.

Natural variations in colour, grain and sound, as well as changes caused by temperature or humidity, do not constitute defects.

5. Right of Withdrawal and Statutory Exclusions

Consumers generally have a 14-day right of withdrawal for distance contracts pursuant to Section 312g(1) in conjunction with Section 355 of the German Civil Code (BGB).

The right of withdrawal is excluded where a statutory exception under Section 312g(2) BGB applies.

The following exclusion applies to our shop:

Section 312g(2), no. 3 BGB

“The right of withdrawal does not apply to contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.”

As musical instruments can no longer be sold as new goods once their packaging has been opened or they have been played, they are excluded from returns.

6. No Returns of Instruments

Returns or exchanges of musical instruments are generally excluded unless the instrument has been damaged in transit.

7. Guarantee for Damage in Transit

All orders are shipped using insured delivery with a tracking number (e.g. DHL).

Returns are only possible in the event of damage in transit, provided that the following conditions are met:

1. The goods are inspected on the day of delivery.

2. The damage is reported on the same day.

3. A video or photographs are provided showing:

   • the parcel;

   • the unpacking process;

   • the damage to the instrument in its original box.

4. The goods are returned in their original box.

Only in this case will we cover the return shipping costs or provide a replacement or refund.

8. Prices and Payment Terms

All prices include statutory VAT.

The available payment methods are displayed during checkout.

9. Delivery

Delivery will be made to the shipping address provided by the customer.

Delivery times are non-binding unless expressly agreed otherwise.

10. Retention of Title

The goods remain our property until payment has been received in full.

11. Liability

We are liable only for damage resulting from intentional misconduct or gross negligence.

In cases of ordinary negligence, we are liable only for breaches of essential contractual obligations.

12. Data Protection

Personal data is processed in accordance with our Privacy Policy.

13. Final Provisions

The laws of the Federal Republic of Germany shall apply.

If any provision of these General Terms and Conditions is invalid, the validity of the remaining provisions shall remain unaffected.
